April 28, 2021A newspaper that was involved in litigation under the California Public Records Act (PRA) with a city and a police officers association regarding a shooting was entitled to an attorney fee award under the private attorney general statute, Code Civ. Proc., § 1021.5; The trial court, which found that the ADA lawyer newspaper satisfied all the statutory requirements of § 1021.5, erred in declining to award the newspaper any fees under § 1021.5; The trial court did not abuse its discretion in finding that the newspaper was the prevailing party under the PRA only for the narrow matter of fees incurred during appellate mandamus review and the subsequent hearings over additional unredactions.
Affirmed in part, reversed in part, and remanded with directions.
